These Terms of Service ("Terms") govern your use of Imagentra's AI image generation services made available through websites and applications operated by our business customers ("Stores"). By using Imagentra, you agree to these Terms.

Imagentra is operated by Qalistic LLC, established in the Republic of Bulgaria, European Union.

1. Description of the Service

Imagentra enables users to generate AI-assisted images by submitting text prompts and/or reference images through participating Stores.

The Service uses artificial intelligence technologies provided by OpenAI to generate image results.

Imagentra continuously evolves and may change or improve its functionality without prior notice.

2. Eligibility

You must use Imagentra only if you are legally permitted to do so under the laws applicable to you.

If you are under the legal age required in your jurisdiction, you may only use the Service with the permission of your parent or legal guardian.

3. User Responsibilities

You are solely responsible for:

• every image you upload;
• every prompt you submit;
• every generated image you choose to use;
• ensuring you have the legal rights to upload all reference images;
• complying with all applicable laws.

You represent and warrant that your uploaded content does not infringe any copyright, trademark, privacy, publicity or other legal rights of any third party.

4. Prohibited Content

You may not use Imagentra to upload, generate or distribute content that includes or promotes:

• child sexual abuse material;
• sexual exploitation;
• explicit nudity where prohibited by law;
• graphic violence or gore;
• terrorism or extremist content;
• hate speech;
• harassment or threats;
• illegal drugs or criminal activity;
• fraud or deception;
• malware or malicious code;
• impersonation of another person for unlawful purposes;
• copyrighted material without authorization;
• personal information belonging to another individual without lawful authority;
• any content prohibited under applicable law.

Imagentra reserves the right to suspend or permanently terminate access for violations of these Terms.

5. AI Generated Content

Artificial intelligence is probabilistic.

Accordingly:

• results may differ between identical requests;
• outputs may contain inaccuracies, artifacts or unexpected elements;
• no specific result is guaranteed;
• Imagentra does not guarantee that generated images are suitable for commercial or legal use.

You remain solely responsible for reviewing all generated content before using or publishing it.

6. Ownership

You retain ownership of the images and other content you upload, subject to any third-party rights that may apply.

Imagentra does not claim ownership of your uploaded images or generated images.

You remain solely responsible for determining whether you have sufficient rights to use, distribute or commercialize generated content.

7. Privacy and Confidentiality

Imagentra is designed to protect your privacy.

Unless required by law:

• only you can access your uploaded reference images;
• only you can access your generated images;
• participating Stores cannot access your uploaded images;
• participating Stores cannot access your generated images;
• participating Stores cannot access your prompts;
• participating Stores cannot access your IP address through Imagentra.

Statistical information shared with Stores is designed so that individual users cannot be identified through the Imagentra platform.

8. Security

Images and communications are transmitted using encrypted HTTPS/TLS connections.

Imagentra applies appropriate technical and organizational measures designed to protect user information against unauthorized access, disclosure, alteration or destruction.

Access to user content is restricted to authorized personnel only where reasonably necessary for:

• customer support;
• service maintenance;
• security investigations;
• abuse prevention;
• legal compliance;
• improving the Service.

9. AI Processing

Uploaded images and prompts are processed only for the purpose of generating the requested output.

To provide the Service, your prompts and uploaded reference images are shared with OpenAI, the AI provider used by Imagentra.

Imagentra does not sell your uploaded images, generated images or personal information.

Your content is not shared with participating Stores.

10. Storage and Retention

Uploaded images and generated images are generally retained for up to 30 days.

Certain information may be retained for a longer period where reasonably necessary for:

• legal obligations;
• fraud prevention;
• abuse investigations;
• dispute resolution;
• security;
• protection of the Service.

11. Image Access

Links to your generated images are available only through:

• your browser session and history (where applicable);
• emails sent to you by Imagentra or the participating Store (where applicable);
• any links you choose to share yourself.

You are responsible for safeguarding any image links that you share.

12. Availability

While Imagentra strives to provide a reliable service, uninterrupted availability cannot be guaranteed.

Imagentra may be unavailable due to:

• maintenance;
• infrastructure failures;
• internet disruptions;
• third-party service interruptions;
• security incidents;
• events beyond our reasonable control.

13. Fair Usage

Use of Imagentra is subject to usage limits established by the participating Store's subscription.

Attempts to bypass or abuse these limits may result in suspension or termination.

14. Government Requests

Imagentra may disclose information where required by applicable law, court order or legally binding request from a competent governmental authority.

15. Limitation of Liability

To the maximum extent permitted by law, Qalistic LLC shall not be liable for:

• AI-generated content;
• decisions made using generated images;
• business losses;
• lost profits;
• indirect or consequential damages;
• interruptions caused by third-party providers, including AI providers.

The Service is provided on an "as available" and "as is" basis.

16. Changes

Imagentra may update these Terms from time to time.

Continued use of the Service after revised Terms become effective constitutes acceptance of those revised Terms.
