IMAGENTRA STORE TERMS OF SERVICE

These Terms govern the use of Imagentra by businesses subscribing to the Service.

1. Subscription

Imagentra is provided as a subscription-based SaaS platform.

Access remains active while the subscription is valid and all applicable fees are paid.

2. Widget Integration

The Merchant integrates the Imagentra widget or other supported integration methods into its own website or application.

The Merchant is responsible for:

• correct implementation;
• maintaining compatibility with its website;
• complying with applicable laws relating to its customers.

3. End Users

The Merchant acknowledges that Imagentra has been designed to protect End User privacy.

Through Imagentra, the Merchant cannot access:

• uploaded reference images;
• generated images;
• prompts;
• generation history;
• user IP addresses.

Nothing in these Terms prevents the Merchant from collecting information directly from its own customers outside Imagentra.

4. Statistics

Imagentra provides operational statistics relating to image generation.

Statistics are retained for a minimum of twelve (12) months, unless otherwise specified.

Statistics are designed to support business reporting while protecting End User privacy.

5. Fair Usage

Each subscription includes usage limits.

Limits may include:

• generations;
• continuations;
• uploads;
• storage;
• processing capacity.

Attempts to circumvent usage limits may result in suspension.

6. Payments

Subscriptions are payable through:

• Stripe;
• bank transfer;
• other payment methods approved by Imagentra.

Failure to pay applicable fees may result in suspension or termination.

7. Merchant Responsibilities

The Merchant is responsible for:

• all content published on its website;
• compliance with applicable laws;
• informing End Users about Imagentra where required;
• obtaining any legally required consents;
• providing first-line customer support.

8. Availability

Imagentra is provided on an "as available" basis.

While reasonable efforts are made to maintain availability, uninterrupted operation cannot be guaranteed.

9. Suspension

Imagentra may suspend or terminate access where reasonably necessary, including for:

• non-payment;
• abuse;
• illegal activity;
• repeated violations of these Terms;
• attempts to compromise the security of the Service.

10. Liability

To the maximum extent permitted by law, Qalistic LLC shall not be liable for:

• AI generated outputs;
• business interruption;
• lost profits;
• indirect damages;
• interruptions caused by OpenAI or other third-party providers.
